(“Forge”, “our”, “us” or “we”) are committed to protecting and respecting your privacy in connection with your use of our website, www.forgesa.com (the “Website(s)”), applications “Apps”) and other products, services and features thereof (the Website, the Apps and such other products, services and features are collectively referred to herein as the “Product” or “Products”, which may be updated from time-to-time at the sole discretion of Forge). This privacy policy (“Privacy Policy”) and any other documents referred to herein set forth the basis on which any personal information we collect from you, or that you provide to us, in connection with the Products will be processed by us. Please read the following carefully to understand our practices regarding your personal information and how we will collect, use and disclose your personal information.

 

INFORMATION WE MAY COLLECT FROM YOU

We may collect and process the following information about you:

• Personal information including, for example, your name, e-mail address, cell phone number if you complete one of the online forms or email us for any reason.

• Device Information such as operating system version, device type, and system performance information.

 

CONFIDENTIALITY AND SECURITY

The security of your personal information is important to us. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once it is received. Except as described under the “Disclosure of Your Information” section below, we do not provide your personal information to any third party without your specific consent.

 

NEWSLETTERS OR OTHER ELECTRONIC COMMUNICATIONS

If you sign up to receive email newsletters or promotional materials from us we will use the information you give us to provide the communications you have requested. If you inform us that you wish to cancel email newsletters or promotional materials by selecting unsubscribe at the bottom of such communication or by emailing us at help@forgesa.com, we will remove you from our mailing list.  By filling in a form on our platforms you consent to receiving communication and/or promotional material.

 

GEOLOCATION DATA

The app collects GPS location data periodically while viewing the map or when you click the location button, provided you have enabled this feature in your device's settings. This is in order for you to view your current position on the map. A bar at the bottom of the screen will indicate the relative accuracy in metres. These data are not saved and this feature can be disabled in the device's settings. The app does not feature any activity recording feature nor turn-by-turn navigation. Your phone location will be tracked in the background even when the app is in the background. None of this location data is saved or uploaded to Forge. The location data is totally dependent on your device's GPS and network capabilities and cannot be improved or altered by Forge, nor does Forge accept any responsibility for inaccurate geo-location while using the app.

 

TRACKING TECHNOLOGIES

Forge and our mapping service provider, Esri South Africa, use technologies such as cookies, beacons, tags, and scripts to enable a service to recognize your device so you don't have to provide the same information several times during one task.

 

We use third-party trackers to let us know when users have visited the website.

The website uses Google Analytics code to gather statistical information. Google Analytics sets cookies to help us accurately estimate the number of visitors to the website. This is done to ensure that the website is available when you want it and is fast. For more information on how Google Analytics processes this information, visit www.google.com/analytics. 

 

LOG FILES

As true of most websites, we gather certain information and automatically and store it in log files. This information may include Internet Protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. If you receive the HTML-formatted version of our email newsletter, your opening of the newsletter is notified to us and saved. Your clicks on links in the newsletter are also saved. These and the open statistics are used in aggregate form to give us an indication of the popularity of the content and to help us make decisions about future content and formatting.

 

USES MADE OF THE INFORMATION

We use information held about you in the following ways:

• To ensure that content provided by the Products is presented in the most effective manner for you and for your computer or other device/s.

• To provide you with information, products or services related to Forge that you request from us or which we feel may interest you, unless you have requested that we not provide this information.

• To provide you with customer service communications.

• To carry out our obligations arising from any agreements entered into between you and us.

• To allow you to participate in interactive features of the Products when you choose to do so.

• To notify you about changes to the Products.

• We may also ask you to complete surveys that we use for research purposes, although you are not obliged to respond to them and may exit them at any stage.

• Details of your visits to and interactions with the Products including, but not limited to, traffic data, location data, weblogs and other communication data.

 

USES MADE OF THE INFORMATION

• We may disclose your personal information to any member of our group, which includes our mapping service host, Esri South Africa or commercial partners or clients.

• We will not disclose your personal information to third parties, except for, in some circumstances, we may disclose personal information that you have provided to Forge to a third party that offers and/or provides goods or services complementary to our own, but only in cases where you have provided your consent, and where we have provided clear and conspicuous notice at the time the consent was communicated that your email address could be transferred to such other party for the purpose of initiating commercial electronic mail messages. These may only include one of several of the following provided: email address/es, device type, general, non-specific place of residence and age.

• If Forge’s service providers (like hosting, market analytics, and payment service providers) require this information to provide services to Forge. Forge requires each of its service providers to agree to maintain the confidentiality of your personal information disclosed.

• If Forge or substantially all of our assets are acquired by a third party, in which case personal information held by us about our customers will be one of the transferred assets.

• If we are under a duty to disclose or share your personal information in order to comply with any legal obligation such as to comply with a subpoena, bankruptcy proceedings, similar legal process, or in order to enforce or apply our agreements with you; or to protect the rights, property, or safety of Forge, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

 

LINKS TO THIRD-PARTY SITES

The Products may, from time to time, contain links to and from the Products of our partner networks, advertisers and affiliates. If you follow a link to any of these external websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these websites or their policies. Please check these policies before you submit any personal information to these external websites.

 

DATA SUPPLIED BY USERS

Users of the app and website are encouraged to submit geospatial data or other information in order to improve the current trail and point of interest (POI) network on the Forge maps, to the benefit of the community at large. Forge will endeavour to credit the provider of the data where possible in the data attributes, via social media or through written communication. While Forge will never distribute the original supplied data without written consent, Forge may sell, lease or display data or information originally derived from the supplied data, which has been modified and edited. The supplier of the data must consent to this in the Submit GPX button on the website when they submit data, or in writing. Forge takes responsibility to ensure users are aware and consent to this.

 

SOCIAL MEDIA WIDGETS

Our Products include social media features, such as the Facebook Like button, and widgets, such as the “Share This” button, or interactive mini-programs. These features may collect your Internet protocol address, which page you are visiting on or Products, and may set a cookie to enable the feature to function properly. Social media features and widgets are hosted by a third party or hosted directly on our Products. Your interactions with these features are governed by the privacy statement of the company providing it.

 

CHANGES TO OUR PRIVACY POLICY

We may update this Privacy Policy to reflect changes to our information practices. If we make any material changes we will notify you by an in-Product message, email (sent to the e-mail address specified in your account) or by means of a notice in the Products prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices.
